Former Katy Teacher Indicted for Possession and Promotion of Child Pornography

Yesterday, the Houston Chronicle posted an article about a former Katy elementary school teacher, Stephen Sudduth, who was indicted for possession and promotion of child pornography.  According to this article, Sudduth had 57,000 images of child pornography and 1,000 videos of sex involving young children on his computer.

According to the Texas Penal Code, possession of child pornography occurs when a person has some type of visual material, including photographs and videotapes, showing a child under the 18 years of age engaging in sexual conduct.  Possession of child pornography is a third degree felony, which is punishable by 2-10 years in prison and/or a $10,000 fine.   Promotion of child pornography means that a person either promotes or is in possession of child pornography with the intent to promote it.  Promotion of child pornography is a second degree felony, and is punishable by 2-20 years in prison and/or a $10,000.

Arrestado e Ilegal: ¿Puede salir bajo fianza?

Desafortunadamente, si usted ha sido arrestado debido a un caso criminal y aparte no tiene estatus para estar en los Estados Unidos, le va ser dificil salir bajo fianza.

En la mayoría de los casos, los detenidos tienen la opción de salir bajo fianza.  Sin embargo, en ciertos casos, algunos detenidos no pueden salir de la carcel bajo fianza.  Esto puede suceder si el detenido no tiene permiso de estar en los Estados Unidos, como, por ejemplo, cuando alguien entra al país ilegalmente o aunque haya entrado legalmente, tiene un permiso, o sea una visa, vencido. 

Cuando alguien es arrestado, se le pregunta su estatus migratorio.  Si el detenido no tiene permiso de estar en este país, se le impone un ‘hold’ por inmigración.  Esto significa que la persona no podrá salir de la carcel bajo fianza hasta que este ‘hold’ sea levantado o a más tardar, que el caso criminal se resuelva.

Es indispensable tener un buen abogado si ha sido acusado de un delito.  Es aún más importante si su futuro en este país está de por medio.

The Legal Effects of Self-Medicating

It seems pretty common nowadays that people borrow or even buy prescribed medications from family and/or friends.   Sometimes, people do this due to lack of funds, other times it’s due to an emergency, and yet other times it’s due to an addiction.

 

Self-medicating cannot only be a risk to your health, but it is also illegal.  If you are found with prescription medication that has not been prescribed to you, you can be charged with possession of a controlled substance.

 

The charge of possession of a controlled substance can range from a Class B misdemeanor to a 1st degree felony depending on the type of substance and the amount.  This means that the punishment can range from confinement of up to 1 year in county jail and/or a maximum $4,000 fine to confinement for life or a term from 5 – 99 years in prison and an optional fine not to exceed $10,000.

Dallas Man Free 14 Years After Unfair Trial

The Houston Chronicle reports that a Dallas Man is free on bond after serving 14 years of a 40 year murder sentence.  Dallas County District Attorney Craig Watkins discovered police did not disclose evidence that incriminated another suspect.  Unbelievable.  The second most disgusting thing about convicting an innocent person is that the REAL KILLER is still on the loose.

At this point, it is unclear if this Defendant is innocent, but it is crystal clear that he did not have a fair trial or investigation.  This is something one would expect to find in tyrannical, corrupt country, not Dallas, Texas.  The man deserves a fair trial.

It is time for the legislatureto criminalize the intentional hiding of exculpatory evidence.  The law already requires the government to inform the accused of evidence suggesting they are innocent.  In the past few years, the State of Texas has spent millions of dollars compensating the wrongfully accused.  There are very few crimes in the Texas Penal Code worse than taking away years from an innocent citizen.

As for Craig Watkins, it is impossible not to admire his commitment to what is right.  Hopefully, he will be an inspiration to prosecutors and an example of how to do that job.
