El Houston Chronicle publicó una noticia donde tres empleados de una agencia de personal en Pennsylvania, se declararon culpables por conspiración por haber solicitado visas falsas, entre otras cosas.
Aparentemente, estos trabajadores de International Personnel Resources, solicitaban visas temporales para personas que no habían pedido estas visas. Es decir, estos trabajadores obtuvieron un guía de teléfonos de México y solicitaban visas utilizando los nombres del guía. Después de obtener las visas, estas fueron dadas a personas que ya estaban en este país, y así podían ser colocados en diferentes trabajos.
La sentencia será fijada el 29 de marzo del 2010.

Ahora que se avecinan las multiples fiestas de fin de año, les deseamos desde el bufete de Scheiner Law Group, que pasen un tiempo muy feliz con sus amigos y familiares.
Sin embargo, también le suplicamos que tengan mucho cuidado si van a tomar. Las fiestas de fin de año son muy divertidas, pero no estaría nada bonito tener que pasar la noche del primero de enero en la carcel de Harris County. Por lo tanto, si van a tomar, es preferible buscar a un conductor sobrio o buscar los servicios de un taxi.

The Houston Chronicle published a story today about a gentleman who was arrested for having 5 pounds of marijuana in his car on Christmas Day.
According to this article, a driver was attempting to drive through I-80 in Cheyenne, Wyoming, even though it had been closed due to the snow. A Wyoming Highway Patrol Trooper stopped the driver and found that he had 5 pounds of marijuana in boxes which had been wrapped as Christmas gifts. Unfortunately for the driver, not only was the marijuana taken from him, but he was also arrested for driving on a closed road and for felony possession of marijuana.

The days when jail fugitives tried to keep a low profile are over.
According to CNN, Craig Lynch was sentenced to seven years in prison for aggravated robbery, but escaped a British open prison in September 2009 and since then has been on the run. The interesting thing is that since his escape, he has been updating his Facebook profile frequently. Mr. Lynch comments on what he has eaten that day, who his next girlfriend will be and even apologizes for not telling his friends in person that he had escaped prison. British officers are attempting to get Mr. Lynch’s information from Facebook, but have yet to know his whereabouts.

The guilty verdict in the Judge Jackson trial here in Harris County, Texas was a surprise to many. When the DWI video of the complaining witness, Arianna Venegas, was shown in the courtroom a couple of days before the verdict was given, many were surmising the verdict would be a ‘not guilty.’ The DWI video, which was taken on the night of Ms. Venegas’ Driving while Intoxicated arrest, depicted a woman who appeared to use her God-given femininity in exchange for officer leniency. In the video, Ms. Venegas speaks to the officer in a sensual tone, attempts to establish a first-name relationship with the officer and flatters him by comparing him with the arresting officer who had, according to her, hurt her feelings. During cross-examination, Ms. Venegas refused to admit that she had tried to use her looks and overtly friendly personality in exchange for better treatment from the officers, despite the fact that the video showed the contrary.
A woman who attempted to entice a police officer who did not have the authority to release her, while knowing that she was being videotaped seems much more apt to do the same with a judge who does have authority and power. As Judge Jackson’s defense attorneys have said, Judge Jackson might have done something stupid by meeting with Ms. Venegas in a restaurant, but that does not mean that he did anything illegal.
On another note, during a jury trial, the jurors who are hearing the case should be impartial individuals, who should decide on a verdict based only on the information heard during the trial. Although jurors are not supposed to be influenced by external information, they are, especially in cases involving a public figure, where newspapers and television stations provide incessant reports. Unfortunately, although these fountains of information should not be biased, they are, and the reporting that is done is never simply informational. For instance, the evening before closing arguments were going to be given, KTRK legal correspondent, Joel Androphy, stated that the accusations regarding Judge Jackson’s actions made him guilty. Mr. Androphy should not be making such inflammatory statements. Only the jurors can provide a verdict, but apparently, stations such as ABC already had a verdict, long before one was given.

De acuerdo con el periódico, The Houston Chronicle, arrestaron a dos mexicanos en Nuevo México el día del lunes, 21 de diciembre, debido al tráfico de drogas. Jorge Sánchez y Felipe de Jesús Herrera-Gandara son acusados de transladar droga desde el oeste de Texas a Nuevo Mexico. Despues de una confesión por parte de Jorge Sánchez, los agentes lograron confiscar 5 onzas de cocaina, cuyo valor es aproximadamente de $14,000. Por el momento, Herrera-Gandara como Sánchez no han podido salir bajo fianza por problemas de inmigración.
En los últimos años se ha visto que más y más gente se está involucrando en el tráfico de drogas. Esto en muchas ocasiones ocurre por simple necesidad económica y no por maldad. Pero, desafortunadamente, el tráfico de drogas en los Estados Unidos, como en muchos otros países, es muy penado. Dependiendo del tipo de droga, la cantidad, y otros factores, la máxima condena podría ser de pena perpetua.

El Houston Chronicle redactó una noticia donde el Departamento de Defensa fue hallado en desacato. Como nos cuenta este diario, aparentemente una jueza federal ordenó al Departamento de Defensa que grabase el testimonio de un detenido yemení que se encuentra encarcelado en Guantánamo. En lugar de seguir las instrucciones de la jueza, el Departamento de Defensa no grabo el testimonio de este detenido, quien cuestiona su detención desde el año 2002. La jueza, por lo tanto, falló que el Departamento de Defensa incurrió en desacato.
Desafortunadamente, aquí no sabemos exactamente lo que pasó. ¿Por qué se niega el Departamento de Defensa a hacer esa grabación? ¿Qué es lo que quieren esconder? Obviamente, tiene que haber algún motivo. Talvez, la meta del Departamento de Defensa es posponer la libertad del detenido u otra razón podría ser que una grabación podría tener repercusiones negativas para ellos. Dudo mucho que se les halla olvidado grabar su testimonio.
