The Houston Police Department, in conjunction with several State law enforcement agencies, and Mother’s Against Drunk Driving, have announced a “no refusal” weekend for the Fourth of July (read the news story here) to beef up DWI enforcement. This means that anyone detained on suspicion of DWI who refuses a voluntary breath or blood test, will probably be subject to a mandatory blood draw. In addition to the “no refusal” weekend, additional DWI patrols are planned for June 27 through July 6.
Of course, for a mandatory blood draw to be authorized, there must be a search warrant in a DWI case, but usually, there are judges on call in Houston to sign search warrants over “no refusal” weekends.
